Edwards Aquifer Authority Rule Proposal Affects Convenience Stores & Bulk Plants! The Edwards Aquifer Authority (EAA) has a lot of environmental jurisdiction in Uvalde, Real, Medina, Bandera, Bexar, Kendall, Comal, Blanco, Hays, Travis, and Williamson Counties. This is because it has responsibility to protect the water quality of the Edwards Aquifer, which supplies drinking water to much of south-central Texas. The EAA has issued a proposal to add rules that will regulate all facilities that store more than 10,000 pounds of hazardous materials. The intent of the rule is to keep these facilities from spilling or releasing hazardous substances that will then degrade water quality at ground surface and down into the Edwards Aquifer. In the counties listed above, land may be in the Edwards Aquifer “Contributing Zone” (the zone that receives rainfall and drainage that heads into the recharge zone), the Edwards Aquifer Recharge Zone (that zone that allows rainfall and surface water to percolate – sometimes very rapidly – into the aquifer), and the Edwards Aquifer Transition Zone (the zone that might allow some percolation of surface water, and of contamination to the aquifer – but far less than what happens in the Recharge Zone). This rule proposal is going to cost each UST and AST owner in these counties a lot of new money – building larger containment structures, doing a better job of preventing and arresting spills, and reporting a lot of information to EAA. TCEQ Rule Changes for LPST-Related Work In keeping with the Texas legislative change made in spring 2007, TCEQ is working on a rule change to – slowly but surely – take newer LPST cases out of the “Texas Risk Reduction Program” (TRRP) rule set, and put them back into the Chapter 334 rule set. This will save a lot of money in site assessment and cleanup costs on these newer releases.
